Dear Major Cook: Shut up and fight

The Columbus (Georgia) Ledger-Enquirer reports that Army reservist Major Stefan Cook has filed a court motion seeking an injunction and conscientious objector status to avoid having to be deployed to Afghanistan. His argument? It would be illegal for him to serve overseas under President Obama as Commander-in-Chief because Obama was not born in the United States:

Honestly, I think we’re all pretty tired of this Obama birth certificate nonsense. Skeptics have had ample time to back up their claims that there is something wrong with Obama’s 1961 Hawaii birth certificate, without success. Like it or not, Barack Obama is the President of the United States and the Commander in Chief of America’s armed forces. And that’s not going to change for a few years.
Even if there were something in the birth certificate story, the idea that an individual soldier’s opinion on that question is of legal validity is pretty ridiculous. That’s sort of like the folks who claim they don’t have to pay taxes because of their personal interpretation of whether they are constitutional. This is why we have courts to decide these questions. You may not like the court’s judgment, but that doesn’t mean you get to substitute your own.
So with all due respect to Major Cook for your service to our country as a reservist: It’s time to shut up and fight for your country. That’s what you signed up for. I don’t blame you if you’re afraid of getting killed in Afghanistan, but that doesn’t make it OK for you to try to weasel out of your commitment on a technicality while your fellow reservists risk their lives. If you were a “conscientious objector” – a true pacifist – you never should have joined the reserves in the first place.

Sir, if you have read this blog AT ALL, you would certainly know its author is NOT an Obama-worshipper, if there is such a thing. In fact, at times, I might say just the opposite!
You may not read things you LIKE here, but you most definitely will read the facts. And those of us who love to read these columns more than all others combined (because we aren’t just looking for things we agree with and we like intelligent commentary) would appreciate reader comments and criticisms that MAKE SENSE and aren’t filled with typical extremist name calling.

By the way, this was a great commentary and an honest persective. People will use any excuse they can not to follow through with their commitments. And sometimes the excuses are somewhat legitimate, but they are still excuses.

Interesting update on this case. According to Cook’s lawyer, the military has revoked his deployment order, without explanation:

However, they are planning to continue with their lawsuit anyway, which is pretty silly because the military has just undercut the entire basis for Cook’s case; he will be found to lack standing to sue on the issue of Obama’s citizenship because it no longer affects him directly. It amazes me sometimes how ignorant lawyers can be of the law and seemingly not be embarrassed at all by their own incompetence.
It’s worth noting that the partisan website reporting this didn’t make any attempt to talk to anyone other than Cook or his lawyer for their “story”, so there’s no confirmation yet from any other source that the deployment order has been revoked.

I agree with sanityinjection; this birth certificate nonsense is right-wing trutherism. It has been denounced as such by no less than Michelle Malkin and David Horowitz. Major Cook has no right to refuse orders based on this scam.

At least the guy apologized and realized his error. Eh, it happens…a lot usually. Good post on this.

Further update: Two other military officers have joined Cook’s lawsuit. Cook now claims he is the victim of retaliation, having lost his job with a DoD contractor and claiming he is the victim of “gossip” that he is “manipulating his deployment orders to create a platform for political purposes”:

I can’t really say whether Cook lost his job because of DoD retaliation or because he’s an asshat, but as one of the people “gossiping” about him being a political stooge, I can assure you I needed no prompting from anyone at DoD or the military to do that. Good luck with that aspect of your complaint, Major Cook. If you don’t like people gossiping about you, try shutting up and doing your job.

The oath taken to join the military states: ” I, (name), do solemly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and alleigence to the same; and that I will obey the orders of the president of the United States and the orders of the officers appointed over me, according to the regulations and the Uniform Code of Military Justice. So help me God.” Obama has not proven his citizenship! By following an illegitimate president any military personnel involved in conflict would be considered war criminals subject to prosecution, and if captured not given Geneva Convention protection!!! Check out the Constitution, Article 2, Section 1. If Obama is indeed in violation, then any executive issues he has ordered while in the “presidency” are null and void, and it would be unethical and illegal for anyone to act in accordance with a fraudulent presidents orders!!!! Technically, the president would be considered a domestic enemy. Cook is right on!!!!

Andrea, you may have a military background, but apparently you don’t know much about our country’s form of government. Nothing in the Constitution gives an individual soldier the right to make a determination about whether the President of the United States is qualified, and then proceed to act on the basis of his or her personal finding. That decision lies with the courts, which have already ruled by rejecting dozens of lawsuits on the matter. For Major Cook to set aside the decision of the Constitutional authority on the matter in favor of his own judgment is a basic violation of the principle of the rule of law.
As for the oath, which I have no doubt you have quoted correctly, you’ll note it doesn’t contain the phrase, “except I don’t have to obey the President if I’m not convinced he is qualified to be President.”
In short, Cook has no standing to sue and should probably be cashiered for insubordination, except that the military wisely doesn’t want to give the guy any more press than he’s already getting.
